Terms and Conditions
1. Scope
These Terms and Conditions ("Terms") apply to all contracts between Veni Vidi Validus GmbH (hereinafter "Provider") and the user regarding the use of the "Voice Appear" software. By registering for or using Voice Appear, the user accepts these Terms.
2. Provider
The provider is Veni Vidi Validus GmbH. The full contact details and information pursuant to § 5 TMG can be found in our Imprint.
3. Subject of the Contract
Voice Appear is a speech-input software for Windows that enables the user to convert spoken language into text and use it in any application. The software processes audio data on servers within the European Union.
4. Free Trial
The user can try Voice Appear free of charge for a period of 14 days. After the trial period ends, a paid membership is required to continue using the software. During the trial, all features are available without restrictions.
5. Prices and Payment
After the trial period, use of Voice Appear is billed via a subscription. Current prices are listed on our website. Payment is made in advance for the respective billing period. The Provider reserves the right to adjust prices with reasonable advance notice.
6. Right of Withdrawal and Refund
The user has the right to withdraw from the contract within 14 days of conclusion, without stating any reason. In this case, the amount paid will be refunded in full. The withdrawal must be sent to the Provider in writing or by email.
7. Usage Rights
The user receives a non-exclusive, non-transferable right to use the software for the duration of the subscription. Use is limited to personal use. Sharing access credentials with third parties is not permitted.
8. User Obligations
The user agrees to use the software only for lawful purposes. In particular, it is prohibited to use the software to process content that violates applicable law. The user is responsible for the security of their own access credentials.
9. Minimum Age
Use of Voice Appear is reserved for persons aged 16 and over. By registering, the user confirms that they have reached the age of 16.
10. Data Protection
The processing of personal data is carried out in accordance with the General Data Protection Regulation (GDPR). Audio data is processed exclusively on servers within the European Union. Further information can be found in our Privacy Policy.
11. Liability
The Provider is liable without limitation for damages resulting from injury to life, body, or health, as well as in cases of intent and gross negligence. For other damages, liability is limited to foreseeable damages typical for the contract. Liability for data loss is limited to the typical recovery effort that would have been incurred with regular data backups.
12. Cancellation
The subscription can be cancelled at any time, effective at the end of the current billing period. Cancellation is made via the user account or by email to the Provider. After cancellation, access remains until the end of the paid period. The right to extraordinary termination for cause remains unaffected.
13. Changes to the Terms
The Provider reserves the right to change these Terms with effect for the future. Changes will be communicated to the user by email at least 30 days before they take effect. If the user does not object within 30 days of receiving the notice, the new Terms are deemed accepted.
14. Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
